TERMS AND CONDITIONS

Bookflightickets.com is an online travel website which facilitates booking of flight tickets from USA-India-USA or vice a versa, and entertains all the related queries prior to the bookings. The customers are requested to go through the Terms and Conditions with caution, once, before availing any of our services.

These Terms and Conditions constitute an overall understanding and an agreement between the two parties involved. Therefore, by booking a ticket online at ‘Bookflightickets.com’, you are thereby agreeing to abide by all these Terms and Conditions without any reservations. The rights to amend or change in the policies are reserved by us. Any change in the policies will be notified and updated on the website.

 

1) General Terms & Conditions

a) Eligibility – The Services offered by Bookflightickets are available for purchase to everyone who have the requisite authority to travel across countries, and are over the legal age to travel.

b) Payments – We accept Payments through:

  • Discover
  • MasterCard
  • American Express
  • Visa
  • MasterCard
  • Bank Transfer/ NEFT
  • All the products and services provided and assured by the Organization are subject to payment realization prior to departure of the flight.

c) Prices

The prices as have been quoted in the Organization brochure(s)/quotation are in USD or its equivalent in foreign currency. The Organization also reserves the right to amend these costs in case of currency fluctuation and because of changes in various exchange rates and/or fuel cost before the departure and to the surcharge accordingly. All such price increases must be fully paid for whenever the same arise.

Once the booking has been made no refund request will be entertained.

The following are NOT included as a part of the cost:

  • Extra baggage charges
  • Custom fees
  • Port charges
  • Immigration fees
  • Inspection fees
  • Airport parking
  • Departure taxes levied by foreign governments
  • Cost of passports and Visas

However, if any of the above are stated in the offer description, then the costs will be included in the package.

d) Issuing Travel Documents – The traveller must ensure to provide correct information for the issue of travel documents. Bookflightickets does not hold any liability if furnishing of incorrect details hinders the process.

The travel documents issued under any name will only be sent to the person who has placed the order and has agreed to our Terms and Conditions. If you are booking tickets on behalf of someone, then it is implied that you have taken the necessary legal approvals to do the same on behalf of that person. You hereby indemnify Bookflightickets for any legal consequences arising due to that.

e) Cancellations and Alterations Policy – The cancellation of tickets are subject to our Cancellation and Altercations Policy, which vary from one offer to another. The policy can be reviewed by the customer before making the booking via E-mail. In case of doubts, please clear them via mail or direct call on our toll free number.

Sometimes, due to the political or environmental changes, the rescheduling of flight times and routes is beyond our control. We have to cancel or make changes to confirmed bookings on such occasions.

Although, we make it our priority to not hamper our customer’s comfort, but we reserve such a right in times of emergencies. We will notify you of such changes as soon as possible, and would be ready to offer convenient re-arrangements.

We will offer you at least one flight of equivalent standard of your original booked flight (you will not have to pay any more prices). If the Tickets are now cheaper, we will refund you your extra payment. It is your choice to avail the alternate offer made to you. In case you wish not to accept it, a full refund will be made to you.

*Please make a note that above options are not applicable if a change made is minor and not causing a significant delay.

Important: All bookings of airline tickets are generally non-refundable unless otherwise stated in offer description.

CHANGES AFTER PURCHASE: Any changes in the bookings after purchase are strictly restricted to airline fare rules. Flight timing and dates are subject to change as per the availability, and payment confirmation. If the confirmation is made after the specified time frame, additional costs may be levied.

In the event of cancellations, the agent’s bill and administrative costs will be deducted from the refund payment, as per the agreement.

f) Insurance – We at Bookflightickets offer no insurance services, and are not responsible for any uninsured loss of the customer. We therefore, recommend to all the travellers to make their insurance purchases separately before going on any trip. Our customer care providers may refer you to insurance companies, to support your travel arrangements. It is the traveller’s sole responsibility to research the reliability of the company though.

g) Seller of Travel Disclosures – Bookflightickets has a trust account as per the requirement of the law of Delaware. Bookflightickets is a member participant of Delaware Travel Consumer Restitution Fund (TCRF).

*Customer making purchase from outside Delaware, the transaction is not covered under TCRF.

h) Valid Passports, Visas – It is not our responsibility to verify whether or not the customer has the necessary visas and passport before making the trip. A valid passport and travel visa is required to travel by air, to any place outside the U.S. The traveller must ensure to be in possession of the above two and carries the other travel documents furnished by Bookflightickets on the basis of information given by the customer.

*International Trips from USA to India require a passport valid until 6 months beyond the scheduled end of your Itinerary. Travelling without a visa to a place (India requires you to at least have a tourist visa)where it is required, can lead to imprisonment until you can be sent back, which is subject to the availability of return tickets.

It is your responsibility to check the details of such pre-arrangements to be made prior to the travel, and ensure you possess valid documents and have obtained the essential vaccinations, and got all the clearances to travel. We cannot be held responsible for any delays due to issues concerning the above. No compensation will be made by us in case you are unable to board the booked flight resulting from your failure to meet these requirements.

i) Marketing Materials – Bookflightickets illustrates its services using photographs and descriptions only for referral purposes. We do not guarantee the exact same services or conditions available at the destinations pictured on our blogs or anywhere on the site.

The information we have on our site, comes from diverse sources, of which certain cannot be verified entirely and might be inaccurate. TheTravellers are therefore advised to make use of their own discretion.

j) Limitation of Liability – Bookflightickets is a mere facilitator, and in No event will be LIABLE for any indirect, incidental, exemplary or punitive damages of any type (without any limitation). Damage claims resulting in loss of opportunity, exceeding the total payment made by the customer under the agreement will not be Bookflightickets’s Liability.

k) Local Customs and Laws – Travelling to a foreign land will make the traveller come face to face with new customs and laws that he may not be accustomed to. Thus, the traveller must be prepared to cope with the risks involved. Availing our services, means that the traveller acknowledges this and will not hold us responsible for any such unwarranted experience after unboarding the flight, or even during the air-travel.

Disclaimer of Warranties – All services on offer are being provided on ‘As Available basis, unless and until stated otherwise.

“TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, BOOKFLIGHTICKETS DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES OF ANY TYPE, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, SUITABILITY FOR A PARTICULAR PURPOSE, TITLE, UNINTERRUPTED SERVICE, AND ANY WARRANTIES ARISING OUT OF A COURSE OF PERFORMANCE, DEALING OR TRADE USAGE FOR ALL SERVICES SOLD BY BOOKFLIGHTICKETS.” Material law in your locale may not permit the rejection of inferred guarantees, so the above prohibitions may not have any significant bearing to you.

2) Air Travel Services

a) General conditions governing air transport

Bookflightickets’s responsibilities in respect to air travel are limited to facilitate your air-ticket bookings only. Bookflightickets does not hold the right to specify the type of aircraft that would be used by any airline. Also, Bookflightickets has no power over the extra charges levied by a certain airport or airline. Bookflightickets is also not responsible for any kind of losses incurred due to flight cancellations, changed routes, or seats. The airlines have right over adjustments of flight timings and schedules. Bookflightickets cannot be held responsible for such changes and will not provide refunds for missed flights due to such irregularities.

In case of a stop-over, if the second flight is scheduled to take off from another airport, the travel to the second airport will be at your own expense. Bookflightickets will not reimburse you for that, and will not have any liability in case you miss the next flight.

Bookflightickets will not take any responsibility in the event of delays, or timetable shifts arising from labor disputes, strikes or weather issues.

Bookflightickets.com reserves the right at any time and due to any reason:

  • To cancel a ticket prior to the departure, and if the same is done, its liability would be limited to refunding the money paid by the Traveller, towards the ticket.
  • To amend, alter, differ or withdraw any tour, expedition or facility that has been advertised or published by Bookflightickets.com. Bookflightickets is not liable for any reimbursement, additional expense or consequential loss that is suffered by the Traveller/Group.

No person, other than the Bookflightickets.com, in writing would have the authority to vary, add, modify or waive off any representation, description, Terms & Conditions set forth over here, or other terms as well as conditions regarding tour being booked by the Traveller authorized by the Organization.

The Ticket Cost does not include Insurance Premium cost. The Traveller/Group would have to pay towards any such premium costs themselves.

All tour programmes as well as tour elements are bound by laws, rules & regulations during the entire tour and back. The Organization would have no responsibility in regards to any condition that is brought about by such laws, or due to the act of God.

Problems related to the issuance of e-tickets

The International Air Transport Association (IATA) has imposed new rules, from 1st of June, 2008, regarding the issue of travel tickets. According to the rules, airlines and booking agencies are under the obligation of issuing travel tickets only via the electronic means,i.e., as an ‘e-ticket.’

It is therefore important for the customer to be in regular correspondence with Bookflightickets on E-mail and make sure that theyreceive the tickets via the e-mail.

Failure to check-in

Failure to check-in on time, by default, result in cancelling the return flight too. We advise you to contact us to work out on possibilities, if you want to still keep the return flight open; the decision however remains with the airline. We can only intervene. No refunds will be made in case the cancellations are made by the company.

The Return

The return must be re-confirmed within 72 hours of the time of departure. This is a necessary action because if you fail to re-confirm, the airline does not guarantee to hold the allotted seat for you. Bookflightickets makes it a point to warn you before hand, and cannot be held liable if you fail to re-confirm your return flight.

Luggage

Bookflightickets takes no responsibility concerning any loss or damage to your personal belongings, during the transit. The airline is liable to you for your baggage under certain terms and conditions. Thus, any problem regarding the luggage should be sorted out with the airlines itself. It is also recommended that you have all your belongings covered under insurance.

Babies and Infants

Infants (of 2 years or less) are not to occupy a full seat; the cost of the ticket is generally 10% of one seat ticket. A few flights offer reduction on ticket charges for children in the age group of 2 to 11 years.

Pregnancy

There are certain restrictions on pregnant travellers to fly; these vary from one airline to another. It is the responsibility of the customer to check these details beforehand. Bookflightickets will not be responsible for any fee cancellations once the ticket is booked.

Medical and Physical Condition

The traveller ensures to be in good physical and mental condition to make the journey by air. Traveller has to furnish true medical documents and takethe responsibility of any unwarranted complication arising during the flight. Bookflightickets assumes no responsibility of providing any sort of medical care on the flight and any charges levied by the airline over medical assistance will be borne by the traveller. YOU ARE RESPONSIBLE FOR ANY RISKS AND COSTS INVOLVED, if at all you receive any medical support during your air flight journey.

b) In case of any kind of Dispute

Bookflightickets.com is committed to deliver customer satisfaction every time you deal with us, and so if you have any kind problem or dispute related to our product or service, we will try to look into them at the earliest. But if we are unable to do so, you may pursue claims as have been explained in the following sections.

By using our services or dealing with us, you agree to give us the opportunity to resolve any dispute or claim regarding the Website, dealing with our agents, any service or product provided by us, any kind of representation being made by us, or with our Privacy Policy, by contacting Bookflightickets.com Customer Service division. If we are unable to resolve your claims after a discussed deadline, you may seek relief through mediation or in small claims court, as have been set forth in this section.

Any and every Claim will be resolved by a binding mediation rather than in court, except when you assert Claim on an individual basis in court for small claims if they qualify for the same. This includes any Claim you assert against us, our subsidiaries or with any company that offers products or services via us. This also includes any Claim that arose before you accepted listed Terms & Conditions, regardless of whether prior versions of the Terms & Conditions required mediation or not.

There is no need of judge or jury in the mediation, and court review of mediation award is restricted. However, a mediator can award the damages & relief on an individual basis as the court itself, and must follow as well as enforce these Terms & Conditions just as a court would.

Mediations will be conducted by American Arbitration Association (AAA) under its own set of rules, which also include the AAA Consumer Rules. Payment of all filing, administration and mediator fees will be governed by the AAA’s rules, except as provided in this section. You may choose to have the mediation conducted over the phone, based on written submissions, or even in person within the state at mutually agreed location.

Any and every proceeding made to resolve Claims will be conducted only on individual basis and not as a class, consolidated or delegate action. The Federal Arbitration Act & federal mediation law apply to this agreement. Mediation decision may be confirmed by any court that holds competent jurisdiction.

c) Prohibited Activities

All the information including pricing and content used on Bookflightickets.com and the infrastructure that is used to provide such information is either proprietary to us or our affiliates or suppliers. While you may make your travel itinerary’s copies in limited number, for travel or reservations booked via Bookflightickets.com you also agree not to modify, copy, transmit, distribute, display, perform, publish, reproduce, license, transfer or sell any information, products or services and software obtained via this Website. Additionally, you also agree not to:

  • Use Bookflightickets.com’s content commercially
  • Make any false or deceit reservations with Bookflightickets.com
  • Use or access our website content, without any authorization from us.
  • Violate the restrictions of this Website
  • Frame, copy or otherwise incorporate any segment of Bookflightickets.com into some other website without our prior authorization

If your booking shows any sign of fraud, abuse or any other form of suspicious activity, Bookflightickets.com may cancel any travel/service reservation(s) that is associated with your name, email ID or account.

d) Bookflightickets.com Fee

For all agent assisted bookings at Bookflightickets.com, besides travel Supplier’s cost and fees, Bookflightickets.com may charge an added service fee which has been explained below. Also, Bookflightickets.com fees are charged on a per-person or per-ticket basis and are non-refundable. Details are below:

Flight Booking Fee

For Per Person or Per Ticket depending on your ticket class (economy, business or first) we charge booking fee amount USD 0 to USD 100 depending on ticket price.

Passenger types = Adult, child, senior, infant, student, military.

Important Note: Service fees charges are subject to change without prior notice. YOU WILL BE LIABLE TO PAY THE LAST TOTAL PRICE AS QUOTED IRRESPECTIVE OF ANY CHANGE OR CHANGE IN THE SERVICE FEES. Kindly check the total final price carefully.

e) Bookflightickets.com Post Ticketing Fees

All services applicable to agent assisted Cancelations or Changes.

Cancellation & Refunds (After 24 hrs)

Cancellation Assisted by Agent/Future Credit will be up to USD 50.

Cancellation Assisted by Agent with Refund will be up to USD 100 per person or per ticket.

Changes to Existing Booked Tickets (exchange)

For changes to tickets booked with us the following post sales fee is applicable:

Within 4 Hours : Upto USD 25 per person or per ticket

Within 10 Days of Fresh Travel Date1: Up to USD 110 per person or per ticket

Within 10 Days of Fresh Travel Date2: Up to USD 75 Per person or per ticket

Other special services post sales like:

Misspelled Passenger Name (as per the passport the traveller name should be there)

Visa/Passport related services(Need a valid visa for travelling)

Baggage related services (Keep all baggage receipts handy)

No-Show (Documents required to prove why your couldn’t board)

Boarding Denied (Documents required to state the same)

Duplicate Booking (to process the refund, you need to submit the copies of all the tickets and it should reflect the same itineraries which is booked with us)

Are charged extra depending on airlines. (Our services fee depends on success but suggested not to include fares of airline)

If our travel suppliers fare rules permits to credit the refund for cancellation and refunds then only it can be done. The refund request will even be accepted from our end and you should not be a “no show”.

e) Loss of air tickets

You agree to safeguard your tickets (in case of a paper ticket issued in the absence of E-ticket participation by an airline/carrier) and bear any and all costs related to loss or theft. If you lose your air ticket or if your ticket is stolen, Bookflightickets.com advises that you immediately report it to the police and to the airline.

f) Taxes and Fees Charges on Published Price Airline Tickets

Government imposed taxes and fees and any applicable airline imposed fees are either included in your fare or itemized separately on your checkout page to provide a trip cost. Tax rates in effect at time of purchase are applied to your ticket price.

Following:

-On-call or Online Ticket Processing Fee

A nominal processing fee will be levied on all bookings made by you through Bookflightickets.com or via our on-call travel agents. You will be required to pay a processing fee of $25 for US Domestic Bookings and $75 for International Bookings, both applicable over published fare.

– Itinerary Changes/Cancellations/Refunds

Any travel itinerary changes, if permitted by the airline fare rules, may have a change fee charged by the airline typically ranging between $50 and $300 USD per ticket that will vary by market, carrier and specific fare rule. In addition, any changes made with Bookflightickets.com to your itinerary will incur a per ticket Bookflightickets.com processing fee. Please see terms & conditions section 2d above.

-Baggage and Other extra Airline Fees

During the booking process airlines have different baggage allowance so in order to have extra baggage or even some airlines do not offer any free baggage, you have to pay a nominal fee. Bookflightickets.com provides a summary of key terms of an airline’s baggage fees, but each airline should be consulted for complete information about its baggage and other extra fees.

-Entry/Exit Fees

If you are travelling internationally, some countries or airports charge fees upon entering and/or exiting the country. These fees are not included in the ticket price, or the taxes and fees we display on our website prior to purchase. For more information on a specific country’s entry/exit fee, we suggest that you visit www.travel.state.gov prior to departure.

Representations and Warranties – The Traveller must abide by the following:(i) must have requisite authority to enter into and enact upon the obligations under our Terms and Conditions; (ii) must agree to abide by all rules and regulations and comply with all local customs; (iii) must provide accurate information to Bookflightickets to help facilitate a hassle-free service .

Disputes – All disputes will be settled under the jurisdiction of State of Delaware.

Severability and Survivability – Any of the provisions which are seen as unlawful or void, will be deemed severable. These will not affect the enforceability of the other provisions. The customer as well as Bookflightickets must agree to substitute such a point with a valid provision, which is close enough to the intent of the severed provision and has the same economic effect.

Entire Agreement- These Terms and Conditions make up for an agreement between the customer and Bookflightickets. Both the parties must agree to the provisions laid here. Acceptance of our Terms and Conditions is a pre-requisite of using any of our services.
